Vocabul Terms of Service

These Terms of Service (“Terms”) govern your use of Vocabul — the vocabulary-learning website at https://vocabul.app, our iOS and Android apps, and any related services (together, the “Services”). The Services are operated by FOP Kostiantyn Zghara, a sole proprietor registered in Ukraine (“Vocabul”, “we”, “us”, or “our”).

By creating an account, installing the app, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 13 years old (or 16 in countries where that is the minimum age for online services) and able to enter into a binding contract under your local law. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Your account

Authentication is handled by Auth0 on our behalf. You are responsible for the credentials you use, for keeping them confidential, and for all activity under your account. Tell us immediately at hello@vocabul.app if you suspect unauthorised use.

You can sign out, edit your profile, or permanently delete your account from Settings inside the app. Deletion is irreversible and removes your Sets, Cards, and associated data, subject to the retention rules in our Privacy Policy.

3. Licence to use the Services

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial vocabulary learning, in accordance with these Terms. We reserve every right not expressly granted here.

4. Subscriptions, AI credits, and refunds

  • Free tier. New accounts receive a starting allowance of AI credits so you can try the full product.
  • Paid plans. Paid subscriptions are sold through the Apple App Store or Google Play and are managed for us by RevenueCat. Pricing shown in the store at the time of purchase governs your order. Subscriptions auto-renew at the rate disclosed at purchase until cancelled.
  • Credits. Each paid period grants a credit allowance for AI features (Card Completion, Term Suggestion, embedding generation). Credits are denominated in our internal unit, are not redeemable for cash, and unused credits expire at the end of each billing period unless we explicitly state otherwise.
  • Cancellation. You can cancel from your device's subscription settings or via Settings → Manage subscription, which opens the RevenueCat Customer Centre. Cancellation stops future renewals and takes effect at the end of the current period; you keep the credits already granted for that period.
  • Refunds. Refunds are handled by Apple and Google under their store terms. We cannot issue refunds directly for store purchases. Where mandatory consumer-protection law in your country gives you a statutory withdrawal or refund right, that right applies in addition to the store policies.
  • Price changes. We may change subscription prices going forward; any change will only apply to renewals after we have given you notice in line with the applicable store rules and law.

5. AI features

The Services use AI models provided by third parties to generate definitions, suggest root forms, detect duplicates, and power semantic search. AI output may be inaccurate, incomplete, biased, or out of date. You are responsible for checking the output before relying on it for any meaningful decision (for example, before submitting work in an exam, email, or publication).

You agree not to submit content to AI features that you do not have the right to send, or that violates Section 7 (Acceptable use). We do not train our own models on your private Sets and Cards, and we ask our model providers not to train their general-purpose models on your inputs (see our Privacy Policy).

6. Your content

The Sets, Cards, terms, definitions, pronunciations, examples, and images you create or upload (“Your Content”) remain yours. You are responsible for Your Content and for having the rights to use it.

To run the Services, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, copy, transmit, display, and process Your Content — including by sending the relevant parts of it to AI model providers — solely for the purpose of operating, securing, and improving the Services for you. This licence ends when you delete the content or your account, except for backups that roll off on the schedule described in the Privacy Policy.

We do not claim ownership of Your Content and we do not sell it. On request, we will provide a machine-readable export of Your Content; ask us at hello@vocabul.app.

7. Acceptable use

You agree not to:

  • Use the Services to break the law, infringe anyone's rights, or harass, threaten, or impersonate another person.
  • Submit content that is unlawful, abusive, defamatory, discriminatory, sexually explicit involving minors, or otherwise harmful.
  • Use the AI features to generate content that violates the law or another person's rights, or to attempt to extract proprietary information about the underlying models.
  • Probe, scan, or test the vulnerability of the Services; bypass our rate limits, paywall, or AI-credit accounting; scrape data at scale; or interfere with the operation of the Services or other users' accounts.
  • Reverse-engineer, decompile, or disassemble the Services except where applicable law expressly permits it.
  • Resell, sublicense, or redistribute access to the Services.

We may suspend or terminate access to the Services if we reasonably believe you have violated these rules.

8. Beta and forthcoming features

Some features of the Services are explicitly labelled as “coming soon” or marked as a beta — for example, the Learn tab and the AI Tutor. These features may be incomplete, may change without notice, and may not be available throughout your subscription. Do not rely on a beta or forthcoming feature for important work.

9. Changes to the Services

We are an actively developed product. We may add, change, suspend, or remove features at any time, and we may release new versions that require an update of the app. We will give reasonable notice of changes that materially reduce the functionality you have paid for.

10. Intellectual property

Vocabul, our logos, the website, the apps, and all software, text, graphics, and designs we provide are owned by FOP Kostiantyn Zghara or our licensors and are protected by copyright, trademark, and other laws. We grant you no rights to our trademarks or trade dress except as expressly stated here.

11. Feedback

We welcome suggestions, feature requests, and bug reports — including those you post on our public feedback portal. By sending us feedback, you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use it without obligation to you. Feedback is not confidential and we are not required to credit or compensate you for it.

12. Termination

You can stop using the Services at any time and delete your account from Settings. We may suspend or terminate your access if you breach these Terms, if you abuse the Services, or if we are required to do so by law. We may also discontinue the Services entirely on reasonable notice. Sections that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and dispute resolution — survive.

13. Disclaimers

The Services are provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that AI output will be accurate, complete, or suitable for any particular purpose. This Section does not exclude warranties that cannot be excluded under mandatory consumer-protection law in your country.

14. Limitation of liability

To the fullest extent allowed by law, neither party will be liable to the other for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, whether based in contract, tort, or any other theory. Nothing in these Terms limits liability that cannot be limited under applicable law — including mandatory consumer-protection rights and liability for gross negligence, wilful misconduct, fraud, or death or personal injury caused by negligence.

15. Indemnification

You agree to defend, indemnify, and hold harmless Vocabul and FOP Kostiantyn Zghara from any third-party claim, loss, or expense (including reasonable legal fees) arising out of Your Content, your violation of these Terms, or your misuse of the Services. This Section does not apply where applicable consumer-protection law restricts it.

16. Apple App Store terms

If you obtained the iOS app from the Apple App Store, the following additional terms apply between you and us — and Apple Inc. is a third-party beneficiary of them:

  • These Terms are between you and us, not Apple. Apple is not responsible for the iOS app or its content.
  • Apple has no obligation to provide maintenance or support for the iOS app.
  • If the iOS app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. Apple has no other warranty obligation in respect of the iOS app.
  • We — not Apple — are responsible for addressing claims relating to the iOS app, including product-liability claims, claims that the app fails to conform to legal requirements, and claims under consumer-protection or similar laws.
  • We — not Apple — are responsible for investigating and resolving any third-party claim that the iOS app or your possession and use of it infringes that third party's intellectual-property rights.
  • You must comply with the Apple Media Services Terms and any applicable third-party terms (for example, your wireless data plan).
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.

17. Google Play terms

If you obtained the Android app from Google Play, your use is also subject to the Google Play Terms of Service. To the extent these Terms conflict with Google Play's rules in respect of distribution and refunds for Google Play purchases, Google Play's rules apply.

18. Governing law and disputes

These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws rules, except where mandatory law of your country of residence provides otherwise. Nothing in these Terms limits any consumer-protection right that applies to you under the mandatory law of your place of residence.

Before filing a claim, please contact us at hello@vocabul.app and let us try to resolve it informally.

19. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted at this URL and the “Last updated” date will change. If the changes are material, we will give you reasonable advance notice in the app or by email. Continuing to use the Services after the changes take effect means you accept the updated Terms; if you do not agree, please stop using the Services and delete your account.

20. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Services.
  • Severability. If a provision is found unenforceable, the remaining provisions stay in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, reorganisation, or sale of assets.
  • Force majeure. We are not liable for failures or delays caused by events beyond our reasonable control, including outages of third-party services, war, sanctions, or natural events.
